MOTION HOUR – MONDAYS

  • Criminal: 8:30 AM

  • Civil: 8:45 AM

Criminal Cases:
All criminal matters are person unless permission has been granted for remote appearance. Attorneys may appear remotely for motion hour matters not requiring the defendant’s presence 
(see Zoom Video Access) without prior approval.

 

Civil & Business Court:
In-person attendance is encouraged, but remote appearance (see Zoom Video Access) is permitted during motion hour without prior approval.

Please be aware of the practical and technological limitations of Zoom that could affect your ability to be heard on contested issues at motion hour.

Zoom “Courtroom” Etiquette

  • All participants must appear by video, unless video is not possible.

  • Join the Zoom meeting using your name and case number (e.g., Atty. John Smith 21-CI-1234).

  • Keep your microphone muted until your case is called.

  • For non-motion hour appearances, you will remain in the waiting room until admitted by the Court.

BUSINESS COURT

 

Business Court motion hour is held weekly on Mondays at 9:00 AM. All Business Court motions should be noticed for 9:00 AM, unless the case is already scheduled on that morning’s regular docket.
 

The regular Business Court docket, which includes case management conferences, pretrial conferences, status conferences, scheduled hearings, and similar matters. These matters are generally scheduled on Mondays beginning at 10:30 a.m.

 

In-person attendance is preferred for all Business Court docket matters. If remote appearance is necessary (see Zoom Video Access), please follow the instructions under Hearings and Other Matters below.

TRIALS

 

All jury trials and bench trials will be conducted in person.

 

The courtroom is equipped with the JAVS 8 presentation system. Counsel are strongly encouraged to test any presentations or media in advance of their scheduled trial or hearing date.

HEARINGS AND OTHER MATTERS

 

Any hearing involving witness testimony or evidence presentation will be conducted in person.
 

Remote appearance is not permitted for trials or evidentiary hearings.

 

Remote appearance may be permitted for other non-motion hour matters if:

  • Notice is emailed to the Court and opposing counsel at least 7 days in advance

  • The notice includes the reason for the request

  • The request is subject to Court approval

Circuit Court is the court of general jurisdiction that hears civil matters involving more than $5,000, capital offenses and felonies, land dispute title cases and contested probate cases. Circuit Court has the power to issue injunctions, writs of prohibition and writs of mandamus and to hear appeals from District Court and administrative agencies.  In Jefferson County, there are thirteen separate divisions, or courtrooms.  Separate judges preside over each division.
